Terms of use

1. About these terms of use

These terms of use explain the rules for visiting and using lumiris.co.uk. By browsing the site you accept them in full. If you do not agree with them, please do not use the site.

The site is operated by AKYT LTD, trading as Lumiris, a company registered in England and Wales under company number 17022802, with its registered office at 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom. You can contact us at contact@lumiris.co.uk or on +44 7470 409015.

These terms of use cover your use of the website. The sale of goods is governed separately by our Terms of Service, and the handling of your personal data by our Privacy Policy.

2. Changes to these terms and to the site

We may update these terms of use at any time, for example to reflect changes in the law, in our services or in how the site works. The version published here is the one that applies each time you visit, so please check back from time to time. We may also change, suspend or withdraw any part of the site without notice.

3. Accessing the site

Access to the site is free of charge, and we do not guarantee that it will always be available or uninterrupted. We may suspend access for maintenance, security or technical reasons, and we will try to give notice of planned work where we can.

You are responsible for arranging your own internet access and for making sure that everyone who uses the site through your connection is aware of these terms and complies with them. Some features rely on JavaScript and on a modern, up-to-date browser.

4. Your account

You may create an account to place orders more quickly and follow your order history. You must give accurate, current information and keep it up to date. You are responsible for keeping your password confidential and for everything done through your account. Tell us immediately at contact@lumiris.co.uk if you think someone else has used it.

We may disable an account at any time if we reasonably believe that you have breached these terms, that the information you gave is false, or that the account is being used fraudulently.

5. Acceptable use

You may use the site only for lawful purposes. You must not:

  • use the site in any way that breaches applicable UK law or regulation, or that is fraudulent or has a fraudulent purpose;
  • attempt to gain unauthorised access to the site, the server on which it is stored, or any connected server, computer or database;
  • introduce viruses, trojans, worms, logic bombs or other malicious material, or launch a denial-of-service attack;
  • use robots, scrapers, crawlers or other automated tools to extract content, prices or images, except for standard search engine indexing;
  • copy or reuse our product photographs, descriptions or page layouts for a competing service;
  • send unsolicited advertising, spam or chain messages through any form on the site;
  • impersonate any person or misrepresent your association with any person or organisation.

Any breach may lead to the immediate withdrawal of your right to use the site, and to a report to the relevant law enforcement authorities.

6. Intellectual property

We own or hold the licence to all rights in this site and in the material published on it, including the Lumiris name and logo, texts, photographs, videos, illustrations, graphics, sound, page layouts, source code and databases. These works are protected by copyright, trade mark and database law in the United Kingdom and abroad.

You may view pages, and print or download extracts, for your own personal and non-commercial use. You must not modify the copies you make, use any illustration, photograph or video separately from the text that accompanies it, or remove any notice of ownership. Any other use, in particular reproduction, distribution, adaptation, public display or commercial exploitation, requires our prior written consent. Unauthorised use may give rise to a claim for damages and, in the case of trade mark or copyright infringement, to criminal liability.

7. Content you send us

If you send us a product review, photograph, comment, question or suggestion, you confirm that it is your own work or that you have the right to share it, and that it is accurate, lawful, not defamatory, not offensive and does not infringe anyone else's rights.

You grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, adapt and display that content on the site and in our marketing, with no obligation to pay you. We may edit, refuse or remove any content that we consider unsuitable, and we may disclose your identity to a third party who claims that your content infringes their rights.

8. Product information and accuracy

We take reasonable care to keep the information on this site accurate and up to date, but we make no promise that it is complete, current or free of error. Product descriptions, dimensions, availability and prices may change at any time. Photographs and videos are illustrative: screens vary, and colours, finishes and light output can look different in your own home.

Nothing on this site is professional, technical or electrical advice. Lighting must be installed by a qualified electrician in accordance with BS 7671 and any applicable Building Regulations. Always follow the manufacturer's instructions, particularly the IP rating of outdoor and bathroom fittings.

9. Links to other sites

Where the site links to other websites, social media pages or resources provided by third parties, those links are for your information only and do not imply that we approve of them. We have no control over the content of those sites and accept no responsibility for any loss or damage arising from your use of them. You may link to our home page in a way that is fair and legal and does not damage our reputation, but you must not suggest any association or endorsement that does not exist, or frame our site on another website.

10. Viruses and security

We do not guarantee that the site is secure or free from bugs or viruses. You are responsible for configuring your own technology, computer programmes and platform to access the site, and you should use your own virus protection software.

11. Cookies and personal data

We use cookies to run the site and, with your consent, to measure and improve it. Personal data collected through the site is processed in accordance with the UK GDPR and the Data Protection Act 2018. Our Privacy Policy explains what we collect, why, how long we keep it, and how to exercise your rights or complain to the Information Commissioner's Office.

12. Our liability

Nothing in these terms of use excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

Subject to that, we exclude all implied conditions, warranties and other terms that might apply to the site and its content, and we are not liable for any loss or damage that is not a foreseeable result of our breaking these terms, or for any loss of profit, loss of business, business interruption or loss of business opportunity. Different limits apply to goods you buy from us: those are set out in our Terms of Service.

13. Suspension and termination

We may end or suspend your right to use the site immediately if you breach these terms of use. When that happens, you must stop using the site and destroy any copies of material you have taken from it. The clauses on intellectual property, content you send us, liability and governing law survive.

14. Other important terms

  • If any provision of these terms is held to be unlawful or unenforceable, the remaining provisions continue to apply.
  • A delay in enforcing any part of these terms is not a waiver of our rights.
  • We may transfer our rights and obligations under these terms to another organisation.

15. Governing law

These terms of use, their subject matter and their formation are governed by the law of England and Wales. You and we both agree that the courts of England and Wales have exclusive jurisdiction, except that if you live in Scotland or Northern Ireland you may also bring proceedings in the courts of the country where you live.
